Subject:   Can you tie up to a dock with old foam?

Premise. I do not own, but rent space at a dock which has not had open foam floats replaced with closed foam floats. I have spoken with owner and been assured that the floats will be replaced, eventually. However, I would actually like to use said space. If I tie up my boat to said dock, could I be fined, or would the owner be fined (if he hasn't already, that is)? Thx.
