I am not positive but I believe that members of Congress are exempt. Rep. Heller of Nevada submitted an amendment to the law that required members of Congress to enroll in the plan. The amendment was defeated. My guess is he wouldn't need such an amendment if they were to be covered. But I do not think it will impact government workers that are part of FEHBP other than if the cost of coverage by providers included in the exchange go up.
