Sorry for your loss, but the laws are the same.  In some cases even stricter on water, i.e. if you get a BUI with anyone under 14yo on board all punishments are doubled. He should never have left the scene of the accident, but in doing so didn't change the circumstances of the initial accident.  Personal responsibility has to be considered also.  If he was 'falling down drunk' why was he allowed to continue driving.  He was not the only intoxicated person on the boat as I understand it.
