Subject:   Sentencing for boating deaths

Just read that young man responsible for two deaths in 2008 on Lake Martin has been sentenced to one year in county jail. His blood alchol content was 0.19; that's about 10-12 drinks, when he ran over people in a pontoon boat. Alabama law does not treat a BUI death the same as a DUI which can be classified as murder. This law needs to be changed.

That does seem pretty light given the circumstances. I would guess that was a plea bargain deal. I defer to the prosecutors on this one as they presumably know all the facts. A tragedy all around.

Things are not always what they seem....no excuses for the young man, he exercised extremely poor judgment and shouldn't have been piloting that boat. But poor judgment seemed to abound that night. There is a question in some minds that the boat he hit was without lights and parked, not in a cove or secluded area but a fairly high traffic area.

The families of those killed were influential in the sentencing...I think they recognized that the young man needed to pay for his crime, but to incarcerate him for a long time would just waste another life.

Really sad all the way around.

The families involved ask for 1 year and 1 day. That is what I was told.
