What are the rules for swim booeys? My neighbor likes to take liberty's with her property and now has swim booeys where I turn my boat. Trying not to be a jerk but it is hard

Hope someone has the answer to this. I have a very similar situation. I understand their desire to put them out, but can't believe that they have the right to do it. The lake bed is not a part of their private property.

How far are the buoys from their dock? I've heard the MP's will not say anything if the buoys are within 50 ft of the owners dock. The buoys cannot be shaped like the official buoys on the lake. If you're turning that close to someone's dock, especially on plane, the buoy may have been put out to get you attention.

My understanding is similar that they are unofficially allowed as long as they don't interfere with navigation and don't extend too far into the lake. It sounds to me like your neighbors do. If you have a good relationship with them I'd stop by and let them know your issue and try to work a solution. Otherwise you will probably need the Marine Police do it for you.

Here is a post from Marin Police on 6/29/2009

A number of people place "swim buoys" or mooring buoys off the ends of their docks. We don't have a problem with this as long as these buoys don't interfere with the normal flow of traffic for the slough and are not placed more than 25-feet from the end of the dock.

Basically, the way I understand it, they can have them, but it doesn't make the water off limits.  As long as they aren't unreasonably extended and interfering with reasonable navigation, the MP won't bother with them.  As much as they may think, putting cute little buoys in a circle doesn't legally make that water space theirs, or does it legally prevent anyone else from coming into the area.
