I thought this deserved it's own topic.

When are they going to outlaw canoes that use more than one paddle?

Seriously though, if you think this ban doesn't affect you, think again. The door has been opened, now anyone can be banned. Ski boats, wakeboard boats, waverunners, pontoons with too many people, bassboats that go over 60 mph..................... it's coming folks. Write the Legislators who are voting on this bill now.

I oppose HB 847 that Rep. Barry Mask introduced. I understand that you are a member of the Agriculture, Conservation, and Forestry Commission which is currently reviewing HB 847. While I understand and appreciate the work you do, we already have many laws in place to deal with boaters that are unruly and being to noisey, driving
to fast or too close to the shore. The "issues" that we are having are
covered under current rules and regulations that are not being enforced.

Please, do not further support this bill.

It's interesting in your letter you say that the problem is that our current rules aren't enforced. Contrary to this sentiment it seems like some folks on this forum are busily thinking about how they can get around the rules instead of just following them. Are we really calling for more enforcement? Couldn't the lake groups quite easily see that we get some more marine police funded if that is what people want. No, I think people want to be fast and loud, and they will do it one way or another regardless. It might just be the fact that people insist on abusing the waterways that has opened the door to future legislation. Further insistence will not close it.

It's unfortunate that a few will try to skirt around the rules. However, banning the entire group because of a few bad apples doesnt' seem right. Sports cars go fast, do we outlaw them? No, we have speed limits in place to punish those who do not abide by the speed limits.

Do you own a boat? or any type of craft on the water? If so, it's in jeopardy of being banned. Banned because someone doesn't like it. I would guess the majority of those boat owners who oppose the large boats are pontoon owners. Most of which, probably have 2 stroke motors on them. Do you know how much oil and gas is placed into the lake because of the 2 stroke motors? We don't ban them from the lake. We allow the # of 2 stroke motors to be reduced by limiting production and slowly discontinuing them......not by banning their users from the lake that they have enjoyed for years.

Nice open mind you have there Bob. It evident that your thinking and the approach of the boat ban are one in the same.

Who's to say that waverunners don't belong in the ocean as well? Do your kids or grandkids enjoy those? They might be on the chopping block next. Imagine having to spend 3 hours in the Tahoe (sucking down $3.35/gallon gas) headed to the coast to ride those.

Do you fish? If you have a bassboat, those might be banned as well. Instead fishing at your favorite part of the lake, which is 15 minutes away by bassboat, you can't go there except on weekends because your bassboat has been banned. So, you have to take a (take for example) 40 hp motor and you can't get to your fishing spot in the afternoon after you have gotten off work.

I hear ya LovenLakeLiven! We here on Lake Martin are now already strapped by this ridiculous ruling. I hope Lake Jordan will be spared the "me too". A group sued the constitionality of the bill but was recently denied. They have said that they will try again.

Years ago San Juan County in Washington outright banned PWC and it was later overturned. With the increasing sales of PWC's and increasing accidents AND with that the increasing noise they had become over run with them. However, it was determined that they have the right to impose restrictions (ie speed limits, no access areas etc) but not completely ban a class of vessel. We will see......

My two cents on the boat ban besides that I don't like it...I find it humorous that people have determined how Lake Martin should be used and by whom including Alabama Power when they both supported and pledged whatever money necessary to defend the boat ban. Yet, last year when the young 16 year old boy from Ohio jumped off Chimney Rock and died many people wanted to fence off the area which Alabama Power Company owns. Alabama Power Co. stated that "Reservoirs are public waterways, open to the public for recreation, and that people are responsible for their own actions." Lake Martin is an Alabama Public Waterway enforced by Alabama State Marine Police paid by State money. I don't know....

I have and will stand up for the rights of each and every individual freedom regardless of their economic status. Maybe a little less government regulation and a little more lessons on personal accountability in every aspect of life! I support you and your effort to fight for your right to not be punished for others actions.
I have seen many a slow oil burning boat, litter bug, trash dumper, cigarette thumper, bottle smasher etc. do more damage to the road side and water of this lake than a fast boat full of people having fun and ENJOYING LIFE each day at a time! Sometimes a little time in the house of self analysis is a good time for days to come.

You know I find myself feeling sorry for you guys who feel so wronged by the "Boat Ban". Do any of you fools sit back and wonder why it is such an unpopular and horrible law was enacted? You are a VERY VOCAL MINORITY. You are not to be taken seriously whiners who make yourselves feel better by propping each other up.

Fight on and you will lose. Why? Because the majority of us have the power. Oh and we probably do have PWC's and that is precisely why they will NOT be banned. I would support a four stroke mandatory deadline in the future for the PWCS to reduce pollution and noise but don't feel strongly about that yet. To compare them to these banned atrocities with their vulgar noise pollution and dangerous capabilites on an inland lake is stupid. Of course that's why you can't drive your boat and I will be on the PWCS all weekend. Get over it!

I am of the slow going pontoon boat type (although I do have a 4 stroke engine so I am not the POLLUTING pontoon type). I have been in a lease with another individual in the Kowaliga area for almost 6 years and have used my pontoon boat the entire time. I don't feel my pontooning is an age thing as I just turned 40. While going fast in a boat is not my idea of fun, I can honestly say I've never been particularly bothered by the ones that do. I prefer drinking beer and smoking cigars and that is hard to do at 50-60 mph. As someone who worked for the government (state) for 10 LOOONNNGGG years, it is my opinion that more government is never a good thing. It's why I left for private business. I drive a Ford Taurus, but I am not in favor of banning Corvettes and Mustang GT's. I'd rather them not run me off the road, but I trust that most people will not do that!!! It's just my opinion, and I could be wrong.

Good ol Alabama.... the good ol boy system is still very much in effect here. It's a WHO you know state over a WHAT you know state and logic can sometimes be tossed aside in order to help out someone you KNOW. Luckily... that tide is slowly turning in this state as it catches up with the real world.

Several 'entities' that were once 'protected' by this inept system/mentality have had the tide turned on them after the adverse effects of decisions made in their favor FOR favors have backfired and the responsible parties all ran for a rock to hide under.

We have enough laws... perhaps we should enforce what we have with impartiality and fairness....

Thanks Steve, excellent post, you will never change their minds, that is why I have decided not to support the HOBOS of Lake Martin any more, they say they are for all boats, but that is simple not true. What they should say is Home Owners and Boat owners under 26' 11" ......or just not say boat owners at all...very sad....as this is a very big lake that should be able to support us all.

And for bob.....well seems like you are the whinner in this one!

I have stated before how fast I have been in a boat...but that is not how fast I prefer to go in a boat all the times....there is a big difference....and I would hope that most of you would understand that....my boat is a 20' Proline that will run 45mph at wot and I perfer to drive about 30mph.....so this Boat Ban does not effect me YET.......that little word YET is so important to me, but it does effect alot of very nice and responsible boaters and families that enjoy Our Public Lake and that is simple not fair, anybody that supports this bill should be ashamed of themselves....it is the operator of the boat that is responsible for it's actions NOT THE BOAT! You are delirious! Many people that don't support the boat ban don't own a restricted boat. Yet they realize that this ban was not put in place for the reasons given and that it is the first step of many to come to both restrict our waterways and give in to the pressures of big buisness.

Have a couple of those jet ski's too and hopefully it is nice enough this weekend that we can get out of the lake house and use them. But you are crazy if you think that there will not be restrictions on those too very soon! California, Michigan, Florida, Minnesota, North Carolina, Oregan, New York, New Jersey, South Dakota, Utah, Nevada, Alaska and many other states never mind other countries all have restrictions. PWC's have the highest sales, according to surveys by the coast guard and the red cross they have the highest ticket rate and injury rate. Lots of unexperienced drivers out there on them. Love being out on mine, not so crazy about some of my lake neighbors kids driving theirs. Maybe I could talk to you and your friends in power.

Will someone please tell me how this law will make Lake Martin a better place? I want to understand that our Government is making this a better place for all of us, but at this time I see only a childish game of “mine, mine, mine”. I do not like it when I or anyone else has a pleasure or right taken from them without good cause, and feel that you have to be more than a little naïve to believe that this is the end of that encroachment.

Speed Limits work on the highway system. So, why can't this be the rule for the Lake? It works in many States. As for not enough man power to enforce it? Think of how many troopers and local law enforcment is on the road and compare that to how many people are driving.

Yes, this legislation will open the door for others to begin removing those items from the lake that they do not like. They are utilizing tools like "Bob" to get this ban passed. However, once this snowball starts rolling, watch out.

Waverunners will be next. They have the highest rate of death per usage. Further implications are taxing of 2 cycle boats for "cleanup" or possibly complete banning of those altogether.

And in the eyes of a boater...they wish you would stop destroying the land and their scenery AND serenity by developing homes, condos and the like on their lake. It is a body of water after all...who is invading who's space? It should not matter. Lake Martin and all the public waterways around the country should be enjoyed and cherished by all that wish to respect them on land and water.

Unfortunatly it didn't play out in the courts. The judge after a very longggggggg thinking decided to support it... funny how he waited until all of the Alabama politicians were back in the local area before he ever made a move. Maybe some persuasion there? Could be. The facts are sad truly. The rights of the people have been taken away, by dirty politics, more rights will be taken away in the future and no there was no public forum.

I do have one question for Bob though, how do you adamantly know for a fact that you are on the side of the majority as you like to say over and over and over again? Without a public forum no one knows for sure. So either you can say you are the Majority because it is in your imagination that you know this to be true, or you can agree that you are really not sure because the PUBLIC was never heard.

Although I hold all the other views. concerns, and other opinions with due respect - this Forum is not going to help other than as a vent.

You need to back your respective views in emails and/or letters to your local State Government Represenative. Here in is the bad news. I am not yet a legal resident of Alabama (not just yet) and have no vote or representative. A large number of the property owners on Lake Martin are either not State residents or a resident of the Couinty they own property in on the Lake. Yet, we pay taxes. I would hazard to guess a vast majority of the boat users who are not property owners are residents of the Great State of Alabama. You are possible the majority in this situation.

I do take offence to the negative comments about the HOBOs; although some come from fhose I consider friends. The Lake Martin HOBOs is what we make it,and you need to join to have a say-so. Therefore, please do not criticize if if you are not willing to be a part of the voice.

I have been to two HOBO meetings, and I have read most if not all of what has been published by the organization. I have yet to hear one thing supporting the Big Boat Ban or can I say that I have seen anything objecting to it.

I will say - I do believe if a majority of the members of the Lake Martin HOBO organization felt one way or the other then it would become an issue for HOBOs to pursue. JUST LIKE ANY OTHER ISSUE FOR THE MEMBERSHIP.

I would only ask that you not point fingers or be critical of things that are not within the sphere of your back itch or should I say butt itch.

Now with the above stated, I would ask anyone who has a single issue with any position of the HOBO organization to please step forward. and state it. Better yet, join and voice your position.

Ok, I listened live to the legislative session when this came up for vote. There were multiple ammendment attempts to this law which would outright ban PWCs on the lakes in question. There was an ammemdment proposed to ban PWC use during the time frame of 6pm and 9am.

This is no joke, you may agree that some of these items make sense to most, but you are lost to the notion that either you or someone you know or are related to will be affected by future legislation. Most of the complaints are because some people have lost their common sense. It doesn't make sense to me for someone to be riding a PWC in circles at 6am, but I don't believe its my right to outlaw it... This is legislating common sense...

It wouldn't make sense for me to ride a PWC at night, but if it has proper running lights, it isn't illegal. I also don't think my opinion should become law. But then, I am not Bob/God and I am not use to making decisions for the poor useless public....

They will not set a speed limit on the lake because it would affect the fishing tournaments which bring in money to these coffers... Also, find a bass boat longer than 26' 11".... Most are well below this and have rediculous horsepower for their hulls.

Including Lake Jordan on this law is baseless. There are no marinas with covered slips. I do not know of a marina with a "Pump out station" on lake Jordan. It is already illegal to house a boat that has a Marine Sanitation Device (sewage system) at a marina with no pump out. So, if there are no marinas with a pump out then there are no "Big" boats... Other than the occasional weekenders who trailer in. BUT the public ramps are not built to support long trailers, so I don't see how big boats are an issue at Jordan to begin with. I guess it makes the representative more popular with the locals who are aparently scared they will be over ran with big boats. Lake Jordan is not desireable enough that it would draw in the big boat crowd anyway.

None of the legislaters are educated on the existing restrictions, and they are only doing what they are being paid to do... (under the table or otherwise).

Either way, regardless if you are for or against further legislation, it is coming!

Feb hope you are doing well.... but I do think I remember one important piece of information here... and I am sure if I am wrong, someone will correct me. When the HOBOs were first established in the beginning... they were not going to take sides on the BOAT BAN at all, it was stated that the point of the HOBOs had nothing to do with the boat ban instead they were going to concentrate on other factors such as lake levels. That the organization would always remain neutral on the Boat Ban subject. However, it becomes hard to trust that fact when you know how strongly board members feel about the Boat Ban.

For example, I don't think anyone would have voted to have CAT on the board for HOBOs because everyone knew that he was against the ban and was fighting it legally. So why elect someone to the board who had direct relations to someone who is publically against it.

Thanks my Dear Friend.

I believe most of your post is accurate; although Cat was solicited both on this Forum during live chat and personally by many inital members of HOBOs to join the organization. I know I had hoped he would, I think Steve will confirm this. Many of us thouht he and the "Cathouse" Company would of been a great sponsor for the Lake Martin HOBOs.

Cat (Steve) thought for personal reasons it would be the wrong thing to do. I will not answer for him, but repectfully allow him to do so if he so desires. Many of us who repect him never questioned his judgement or rationale; although we wished for his support and involment.

I am not a spokesperson for the Lake Martin HOBOs, but I personally think the orgainization would benefit from his involvement and membership.

I will await any rebuttal to the above with an open mind and an appology if I am incorrect with what I have stated.

Feb you know I am not sure if CAT joined or not. It is really besides the point. If he had though I don't think he would have ever tried to run for the board because of his strong opposition to the boat ban... I just wish other members had the same thinking.

I personally have thought about joining the HOBOs on numberous occassions... but there is a fact that keeps me away for the time being.
My family can not spend money that may be used against us. In other words, with someone on the board who votes on the matter of the HOBOs and who is strongly for the boat ban, then we can not be members. It's truly sad, there is so much that we want to do for the lake and to help with... in the mean time we will have to find another way.

We care deeply for the lake and for many of the people on it. We have friends on both sides of this fence... but we do have to stand up for our beliefs... my belief here is that someone who holds such an opinion being for or against something and is so open about this opinion should not be on the deciding committee to an organization that is suppose to be neutral. Hope you and the rest of our friends with the HOBOs understand our position.

The one reason I have not joined the organization is because one or more of the elected members have been so rudely oposing my existance on the lake. The one or more persons I am talking about have made very rude public comments on this board. In my opinion they have poorly represented the purpose of the organization and its members. If I were a member, the first thing I would do is bring up removing those individuals. If I were a member, I would be embarrased to be represented by such boisterous fools. Since that is a derogatory remark, and this is a public forum, I will not be seeking leadership positions any time in the near future l-)

I have no beef with people taking sides and supporting their beliefs. What I do have beef with is an organization that is represented in a public forum by people who act unprofessionally. I would support an organization who was led by people who could communicate their opinions without making personal attacks, and without flying off the handle. These may be good people with good intentions, but they are not good leaders.

There are some who I have met that I would vote for, regardless of their stance on the big boat issue. It would be their character that got my vote, not their opinion.

I think it is great that the organization was formed, and that its intentions are good. I think it would garner more support if it hosted more "Social" gatherings so people could meet one another in an environment other than a formal meeting , such as a BBQ on "Obvious/ longneck island...".
If the organization maintains support of general health and safety issues, and keeps away from financial interests, I may join...

Those are the sentiments I was expressing last year when osms and lakeman were making such vile, arrogant and slanderous statements about me. Opinions are one thing, personall attacks are another. You are so right to point out that the leadership of the HOBO needs to be changed or the membership will dissapear. You can't have your leadership involved in childish, petty internet arguments and mud slinging and expect to hold any level of respect in the community. Not to mention attacking the 'locals' and family members of folks who you disagree with.

Now I think the HOBO is skirting it's responsibillity to the lake community by not supporting the plaintiffs in the suit. The water level 'crisis' is over for now so what more compelling issue is there. Water quality is not now, nor has it ever been and hopefully never wiil be an issue on Martin as there are no polluting industries upstream. Not to mention several groups already heavily involved in that area.

I know some want more regulation over the development of shoreline. I do too, but I want RESPONSIBLE RESTRICTIONS. Not this, 'we have too many condos, you can't build any more' mentallity. Once again, some of the board of the HOBO have been on this forum stating thier vision that all development needs to stop.

Bottom line is you are judged by the company you keep, and the HOBO board is not the company that I think the membership wishes to be judged by.

Correct. I originally intended to join HOBO. Was willing to make a large contribution. If I can remember correctly, I became I'll and side tracked (Heart bypass surgery) and when I was recovering, deciding to file, and getting all the ducks in a row I realized HOBO probably did NOT want me as a member. I also felt that HOBO would not offer me the support I needed at the time. I also DO plan to join HOBO when all this is over. I still like and respect each and every one of you all. You all have different opinions and I certainly respect them.... seriously I do! FEB, you are one that should know, along with MAV and OSMS. I have never disrespcted you once. (unless you took offense to the email I sent OSMS) LMAO> BUT, I'll warn you, when I become a HOBO, yall better watch out!!!! Then after you recouped from the hangover, you retracted your offer and then stated now may not be the proper time with all the Boat Ban stuff, etc.
