I was hoping someone could help me with an issue I am having.

My wife and moved to Pell City last year in July. We love living on the lake, but a new development, the Reserve, broke ground at around the same time.

The drainage from the reserve was routed to a pipe that runs straight into our backyard. The previous owners had gone to a town council meeting to address the issue. I called Mr. Mike Martin, and he told me they would divert the water away from our backyard.

A year has passed an we basically have a small river running through our yard and into the lake everytime it rains. My backyard has been gouged, leaving only exposed rocks in several areas while leaving behind a constant deposit of rocks and sand. My wife emailed Mr. Martin video of the issue. She spoke to him via telephone and e told her the Reserve developers would build a culvert to address this issue but had to wait till summer to do so (this was in December).

This summer I have called Pell City Water and Sewer repeatedly but they have never returned my calls. I have gone by the center 4 times and left messages...
I do not know how to proceed? Should I contact ADEM?

Contact Channel 42 - CBS Affiliate in Birmingham, AL. Ask to speak with the Station Manager. You will most likely be asked to leave a voice mail message. This station is very conscientious regarding situations such as yours. Nothing gets the wheels turning like a little publicity on the wide screen. You can awake the sleeping giants who reside at your county commissioners office, the developers, ADEM and Alabama Power.
Be prepared to stay the course. Take plenty of pictures and document what happens as the situation unfolds. Recording a few quotes from representatives at APCO, the county commissioners office etc. goes along ways toward influencing the decision makers to act! Good Luck.
