Subject:	Motion to Intervene

The Dept of Interior (DOI) - Fish and WildLife has filed a Motion to Intervene on APCo's October 23rd request for a drought based temporary variance.

The Motion did not state what the DOI sought in its intervention. But looks like APCo may not get its drought based variance without a fight.

Just thought I would pass this along as not the best of news as all interested parties had till yesterday to file their comments, protests and motions and the DOI filed its at the last minute.

Information that I have received indicates that this motion is a kind of CYA done by the Dept of Interior. Fish and Wildlife has already given a letter of approval--which was forwarded by APCo when they filed.

Further, the Corps of Engineers finally gave its' graces yesterday afternoon after much arm twisting by Governor Riley.

Current situation looks good for FERC approval on schedule to raise winter level to 483'--if we get rain.
