If as a privileged driver on our nations highways I choose to speed and break the speed laws and pay the fine rather leave early enough not to have to do so, there will come a time when I will lose my license and privilege and face jail and a bigger fine. Who is the mayor of Dadeville to choose to pay a fine rather than fix the problem and the fine is paid with taxpayer money. Are the people of Dadeville stupid?

Do you know something new? My guess is the AG will not aggressively pursue the lawsuit and Dadeville will get off scott free, while the sewage continues to flow.

ADEM's Consent Order assessed a fine of $6500 against the City. It was to be paid within 45 days of the effective date (?) of the Consent Order.

The Civil Action by the AG requests that the Court do the following:

A. Take jurisdiction of this matter.

B. Adjudge and declare that the Defendant violated the terms and conditions of NPDES Permit Number AL0063797.

C. Order the Defendant to take action to ensure that similar violations of the Alabama Water Pollution Control Act, Code of Alabama (1975), 22-22-1 et seq., do not recur.

D. Assess a civil penalty Against the Defendant and in favor of the Plaintiff pursuant to 22-22A-5(18)(b) and (c) for each and every violation of NPDES Permit Number AL0063797.

E. Oder such additional relief as the Court deems appropriate.

F. Tax the costs of this action against the Defendant.

Hopefully the end result of all this is that the City fixes their problem. How and when and at what cost is anyone's guess!

It appears this violation has been ongoing and the city has done very little to fix the issue. That leads me to think that either the city does not have the money to repair the issue or the mayor was leaving the problem for another mayor in the future.

What I find amazing is that Lake Martin produces a lot of tax revenue for the city of dadeville. Why kill the Golden Goose? You would think the preservation of lake Martin would be a top priority for the government of Dadeville if only because it is self preservation.

Your logic makes too much sense. Unfortunately the folks that elect this esteemed mayor, for the most part, don't live on the lake. They are what you pass by on the way to your lake home. These voters care little about the lake unfortunately. On need only look at the litter on the highways and roads in the counties surrounding the lake to see that.

The only way to get action on this issue, I am afraid, is to go beyond state pressures and bring in Federal environmental experts, file lawsuits, and encourage media pressure. If I was retired on the lake and had the time I would make this my full time pursuit but, alas, I am but a "weekend warrior" with little time to spare beyond a letter here and there...

We need some activists at the lake with the time to organize efforts...money I can give, its time I don't have like many people posting here....

I think you would be surprised at the (and I choose my words carefully) apparent animosity that the city mayor/councilmen and county commissioners have for lake residents. I think they see us as elitest who look down upon all non-lake residents. Sadly, those who do not understand that Lake Martin and it's development is the economic engine for this area are the ones who make the major decisions.

I just moved up to the lake a couple of months ago and live there full time. I am relatively young and have just started to get involved locally. I see your point aboutlocals who do not live on the lake and their regard for people wh have the opportunity to live there.

Good points as well about weekend people who travel to the lake and live elsewhere during the week. I guess they vote where they live and not in Dadeville and local communities.

I am not your typical environmenalist but I do believe in hold governments accountable. There are two ways to skin this cat.

Lawsuits and media coverage. I am not sure what the process would be with filing a class action suit against a local government. Any lawyers out there?
